Βαριά κουβέντα το "ηλίθιο": Καλύτερα διάβασε απευθείας τα επιχειρήματα
της επιτροπής ανταγωνισμού διότι αν ήταν ηλίθια σε διαβαιβεώ ότι η
Microsoft θα κατάφερνε να πληρώσει έναν minimum ικανό δικηγόρο για να
αντικρούσει ηλίθια επιχειρήματα.

Παρεμπιπτόντως όλα όσα λες ότι θα μπορούσαν να συμβούν και πολύ
περισσότερα έχουν ήδη συμβεί: η ΕΕ έχει πριν πολλά χρόνια "κηνηγήσει"
δικαστικά την Microsoft για την ενσωμάτωση του media player[1] και την
βρήκε ένοχη. Όσο για το malware scanning έχει γίνει αρκετός ντόρος με
το που ξεκίνησε και λένε ότι αναμίχθηκε και η ΕΕ αλλά η microsoft τα
βρήκε με τους μεγάλους παίκτες και κρατά τις λειτουργίες του malware
removal tool στο ελάχιστο [2]. Και επίσης η ΕΕ δηλώνει επισήμως ότι
ερευνά και άλλες παρόμοιες περιπτώσεις:

"In addition, allegations of tying of other separate software products
by Microsoft, including desktop search and Windows Live have been
brought to the Commission's attention. The Commission's investigation
will therefore focus on allegations that a range of products have been
unlawfully tied to sales of Microsoft's dominant operating system."

φυσικά και το ζήτημα είναι περίπλοκο αλλά όχι άλυτο: δεν υπάρχει
κανέναν ουσιαστικός τεχνικός λόγος που να υποχρεώνει την Microsoft να
κρατά το MSXML API (και κάθε αντίστοιχο API) μέσα στα σωθικά του
Internet Explorer. Μπορεί να βολεύει την Microsoft αλλά οι επιτροπές
ανταγωνισμού δεν υπάρχουν για να προστατέψουν τα συμφέροντα της
Microsoft αλλά για να προστατέψουν εμάς από τα συμφέροντα της
Microsoft. Παρεμπιπτόντως τη δικαιολογία ότι τα πάντα στα windows
είναι αδιάρρηκτα δεμένα την έχει χρησιμοποιήσει σε όλες τις δίκες για
μονοπωλιακές πρακτικές αλλά να σημειώσω ότι η Microsoft έχει επίσης
χάσει ΟΛΕΣ τις δίκες για μονοπωλιακές πρακτικές. Ίσως βέβαια δεν είχε
σκεφτεί τόσο καλά επιχειρήματα σαν τα δικά σου...

The European Commission has concluded, after a five-year
investigation, that Microsoft Corporation broke European Union
competition law by leveraging its near monopoly in the market for PC
operating systems (OS) onto the markets for work group server
operating systems(1) and for media players(2). Because the illegal
behaviour is still ongoing, the Commission has ordered Microsoft to
disclose to competitors, within 120 days, the interfaces(3) required
for their products to be able to 'talk' with the ubiquitous Windows
OS. Microsoft is also required, within 90 days, to offer a version of
its Windows OS without Windows Media Player to PC manufacturers (or
when selling directly to end users). In addition, Microsoft is fined €
497 million for abusing its market power in the EU.

There are reports that the European Union (EU), which previously fined
Microsoft for tying the Windows Media Player to Windows, has asked
companies such as Symantec for information about the malware removal
tools market, signaling that it may want to examine the impact of
Microsoft's integration plans. Acknowledging this concern, Microsoft
has created the SecureIT Alliance to expand security and Internet
safety partnerships it currently has with other industry leaders and
governments, including the Virus Information Alliance (VIA) and the
Global Infrastructure Alliance for Internet Safety (GIAIS), among
others.
